Vatican says the 'butler did it,' orders trial

ROME ? It doesn't get more symbolic than this: dark clouds hung over the Vatican on Monday morning after months of glorious sunshine, just as its spokesman announced the outcome of an investigation into one of the biggest conspiracies to emerge from the Holy See in years.
As explained in a 35-page document issued by the Vatican, a judge charged Pope Benedict XVI's former butler with "aggravated theft" for allegedly stealing and leaking private documents from the pope's apartment to the Italian media.
Paolo Gabriele must now stand trial in one of the biggest conspiracies to hit the Vatican in years.
The documents purporting to contain damaging details of alleged corruption and power struggles among the Church's hierarchy provide a rare peek through the keyhole of the secretive Vatican medieval walls.
'Vatileaks'
The scandal, branded "Vatileaks," started in January after Italian journalist Gianluigi Nuzzi revealed for the first time one of the documents in his television program, "The Untouchables," on the Italian channel La7.

In a private letter sent by Archbishop Carlo Maria Vigano to his superiors, including the pope, he appeared to expose a web of corruption, nepotism and cronyism in the awarding of contracts for the maintenance of the tiny city-state's gardens, buildings, streets, museums and other infrastructure. Vigano complained that much of the work was often given to the same companies at double the cost when compared to what they charged outside the Vatican.
Among the many expenses a medieval state like the Vatican, the cradle of Christianity, needs to maintain its splendor, perhaps the most typical one is the cost of the nativity scene, which adorns St. Peter's Square every Christmas. In one of the leaked letters, Vigano complained that it cost almost $700,000 to put on in 2009, and managed to almost halve its cost the following year.
Despite the cost-saving efforts by Vigano, the archbishop was soon deposed from his post and sent to Washington as a "Nuncio," the Vatican equivalent of an ambassador. What was meant to be a promotion, Vigano denounced as a smear campaign against him by members of the Vatican hierarchy, whom he believed were unhappy about his push for transparency in the church's complex financial structure.
"Holy Father, my transfer right now would provoke much disorientation and discouragement in those who have believed it was possible to clean up so many situations of corruption and abuse of power that have been rooted in the management of so many departments," Vigano wrote to the pope on March 27, 2011, according to the leaked documents.
After the program aired, the hunt for the whistleblower ? colorfully called the "crow" (Italian for mole) ? was on. In Nuzzi's book he or she was called, almost heretically, "Mary."
The Vatican gendarmerie, the Holy See's "police" force, quickly began searching for clues.
Then, as if out of an Agatha Christie novel, the predictable outcome: the butler did it.
The butler did it
On May 23, the Vatican gendarmerie arrested Paolo Gabriele, the pope's personal assistant. He was one of the very few people to have access to the pope's private chambers and was caught red-handed when a stash of secret documents was found in his apartment.

In his possession, authorities also found some presents sent to the pope, including a check for a $130,000, a gold nugget and a rare 16th century book. He was held for 53 days in a Vatican cell before being put under house arrest.
The decision to order Gabriele to stand trial on charges of aggravated theft for leaking the documents was widely expected. But if the butler did it, was he part of a wider whistleblowing operation aimed at shaking up the Vatican hierarchy as some have suggested?
On Monday, the Vatican revealed that at least one other arrest was made during the investigation. Claudio Sciarpelletti, a layman Vatican IT employee, was also ordered to stand trial, but on lesser charges of aiding and abetting a crime.
Big crime in a small country
Officially, the Vatican is one of the countries with the highest crime rate per capita in the world. The surprising statistic is skewed by the fact that, despite there being only 800 residents, there's an abundance of purse-snatchers from abroad (meaning Italy, which is just across the fences of St. Peter's Square). Its sole judge spends a lot of time dealing with mostly petty crimes.
The last serious crime the court had to deal with was the 1998 murder of a Swiss Guard commander and his wife by a young Swiss Guard, who later took his own life.
The trial for the conspiracy that has shaken the Vatican at the top of its hierarchy will not take place until October at the earliest. If Gabriele is found guilty, he risks up to six years in prison.
Unless, of course, the pope can find it in his heart to forgive - and pardon him.

A new Winnipeg-based, female-driven production company has started shooting its first film.
Red Czarina, founded by Danishka Esterhazy, Rebecca Gibson, Ashley Hirt and Rebecca Sandulak last May, has begun work on H&G, a modern retelling of a classic fairy tale ? think Hansel and Gretel with a dark, "neorealistic twist."
"This film is an absolute labour of love," producer Hirt said in a release. "We only have a budget of $5,000, but we have a surplus of talent with our all-Winnipeg cast and crew."
H&G will star Winnipeg actors Ashley Rebecca Moore, Tony Porteous and Ferron Guerreiro.
The shoot is expected to wrap Sept. 2.

CDC: 145 cases of new swine flu strain from pigs
ATLANTA (AP) ? Officials say there's been a five-fold increase of cases of a new strain of swine flu that spreads from pigs to people.
The case count jumped from 29 a week ago to 145 this week, thanks to a wave of new cases confirmed in Indiana and Ohio.
The good news is the flu does not seem to be unusually dangerous, like the strain in 2009 that killed at least 12,000. Two of the new patients were hospitalized, but most illnesses have been mild and no one has died. Most or all of the cases appear to have spread from pigs to humans, meaning it's not very contagious
The Centers for Disease Control and Prevention released the new numbers on Thursday. The patients were infected a week or two ago.

Microsoft reportedly settles on 'Windows 8' as replacement for 'Metro'
We've already heard that Microsoft was temporarily using "Windows 8-style UI" as a substitute for "Metro" now that the latter is on the outs, and it looks like may now have a permanent replacement. According to some unnamed sources speaking to ZDNet's Mary Jo Foley, Microsoft has decided to simply use "Windows 8" as a name for all things once known as Metro. That means "Metro-style applications" will now be known as "Windows 8 applications," and that the "Metro user interface" will now be the "Windows 8 user interface." What's more, Foley also notes that the phrase "Windows 8 apps" has already turned up on the promo page for Lenovo's new ThinkPad Tablet 2, which also indicates that the traditional Windows 8 apps will simply be known as "desktop" apps to distinguish the two. We'll keep you posted if we hear more on the change from Microsoft itself.

TUCSON, Ariz. (AP) ? Jared Lee Loughner agreed Tuesday to spend the rest of his life in prison, accepting that he went on a deadly shooting rampage at an Arizona political gathering and avoiding the prospect of a trial that might have brought him the death penalty.
His plea came after a federal judge found that months of psychiatric treatment made Loughner able to understand charges that he killed six people and wounded 13 others, including his intended target, then-Rep. Gabrielle Giffords.
Loughner appeared relaxed and focused throughout the two-hour hearing, much of it devoted to a court-appointed psychologist's account of his normal childhood, his teenage depression, his descent into schizophrenia as a young adult and his gradual recovery in prison to the point that she felt he was competent to face charges.
The psychologist and judge did most of the talking, as Loughner looked at them intently and leaned slightly forward with no expression, his arms crossed over his chest. He appeared to show emotion only once ? smiling and nodding when the psychologist, Christina Pietz, reported that he formed a special bond with one of the guards at the Springfield, Mo., prison where he has been held.
U.S. District Judge Larry Burns noted Loughner's reaction to the prison guard comment when explaining his decision to declare him competent. He said Loughner was "tracking" the day's proceedings well and appeared to be assisting his attorneys in his defense, a break from the past.
"He's a different person in his appearance and his affect than the first time I laid eyes on him," Burns said.
During the hearing, Loughner didn't exchange words with his attorneys or glance around the courtroom, which was packed with victims. His parents, who observed from a back row, sobbed and embraced after he walked out looking frail on his feet and gazing straight ahead.
Loughner pleaded guilty to 19 counts, including attempted assassination of a member of Congress, murder and attempted murder of federal employees, and causing death and injury at a federally provided activity. As part of the agreement, the federal government dropped 30 other counts.
"I plead guilty," Loughner said repeatedly in a baritone voice as Burns listed each count.
His hair closely cropped, Loughner was not the smiling, bald-headed suspect captured in a mug shot soon after the January 2011 shooting. His demeanor was a complete turnaround from a May 2011 courtroom outburst that prompted Burns to declare him incompetent.
The prosecution and defense seemed eager to seal the agreement, a departure from previous marathon hearings. Judy Clarke, Loughner's lead attorney, gently pointed Loughner through a copy of the plea agreement on the table in front of him as the judge went through it. She declined to ask the psychologist any questions.
The plea agreement calls for a sentence of seven consecutive life terms followed by 140 years in prison, according to federal officials. Loughner, who will be sentenced Nov. 15, is ineligible for parole.
John Leonardo, the U.S. attorney for Arizona, called the agreement a "just and appropriate resolution."
"I hope that today's resolution of this case will help the victims, their families, and the entire Tucson community take another step forward in the process of healing and recovering from this sad and tragic event," he said.
The outcome was welcomed by some victims, including Giffords herself, as a way to move on.
"The pain and loss caused by the events of Jan. 8, 2011, are incalculable," Giffords said in a joint statement with her husband, Mark Kelly. "Avoiding a trial will allow us ? and we hope the whole Southern Arizona community ? to continue with our recovery."
Ron Barber, a former Giffords staffer who was wounded in the attack and later won election to her seat after she stepped down, said he hoped the plea will help the victims and their families "move forward and continue our healing process."
"I truly believe that justice was done today," he said after the hearing. "It is important to me that this individual never again is in a position in which he can cause harm to anyone else."
Susan Hileman, who accompanied slain 9-year-old Christina-Taylor Green to the gathering outside a supermarket and was wounded in the attack, said nothing would return her life to what it was before the shooting.
"This is so sad ? a 23-year-old who's going to spend the rest of his life in a box. I feel empty. What I want, I can't have," she said, adding that she was relieved the case ended. Still, "it's like a Band-Aid that keeps getting ripped off."
Pietz, the court-appointed psychologist, testified that Loughner appeared to be a normal child and average student until he was 16, when a girlfriend broke up with him and a friend's father died. He was diagnosed with depression at the time and landed at an alternative education program at Pima Community College his senior year after he showed up drunk for school one day.
He was enrolled at the Tucson college until September 2010, alarming his parents and friends with his increasingly erratic behavior, Pietz said. He became obsessed with the U.S. Constitution, wrote jumbled words on the chalkboard and a final exam, and yelled incoherently in class.
Loughner's parents, Randy and Ann Loughner, told Pietz that their son once asked them if they heard voices. They worried that he would take his life.
Pietz recounted several turning points in Loughner's recovery in prison: regular exercise; counseling sessions with three other inmates; and prison jobs rolling towels, T-shirts and socks, and stamping envelopes. He has been forcibly medicated for more than a year after being diagnosed with schizophrenia.
"He loves his jobs," she said.
Pietz said Loughner's refusal to acknowledge that Giffords survived and his insistence that a surveillance video of the shooting was a fake made her reluctant to declare him competent. Over time, he acknowledged that Giffords survived the gunshot wound to her head, considering it a failure on his part.
"He's disappointed, this is another failure in his life, he set out to do this," said Pietz, describing his thinking as the realization set in that congresswoman survived.
Giffords has undergone intensive therapy and made dramatic progress recovering from her brain injury, yet her movements and speech are still halting.
For prosecutors, the plea avoids a potentially lengthy and costly trial and appeal, and locks up the defendant for life.
Clarke managed to avoid the death penalty for other high-profile clients such as "Unabomber" Ted Kaczynski and Eric Rudolph, who bombed abortion clinics in the late 1990s and Atlanta's Olympic park in 1996.
One uncertainty hanging over the case is whether Loughner will face state charges. The plea agreement to the federal charges makes no mention of that possibility.
Pima County's top prosecutor said last year that she may file state charges in the case that could carry the death penalty. In an agreement with federal prosecutors, County Attorney Barbara LaWall agreed that the federal prosecution would take place before she could bring charges.
LaWall has been unavailable in recent days, and officials in her office have repeatedly declined to comment, saying the office did not have an active prosecution against Loughner.
A state prosecution after a successful federal one would not be unprecedented. Oklahoma City bombing conspirator Terry Nichols avoided the death penalty on federal charges after a 1997 trial and was given a life sentence. State prosecutors then tried him again, but a state jury also declined to sentence him to death.

Full Time Mama: Summer Activity Guide: Enjoy a meal at Sauce (or ...
Since we're a one income family, we really try to limit the money we spend eating out.? However, when we do eat out we like to be sure our money is well spent.? It's not often we try new places; we know what we like and we want to be sure we aren't sorry for the money we've spent.? So when Fox Restaurant Concepts (FRC) asked us to try one of their restaurants we happily agreed!
The hardest decision for us was whether to make it a family lunch date, or leave the kids at home and go out, just my husband and I.? In the end we decided to go with the kiddos- this time around.? We went to Sauce Pizza & Wine.
Walking up to the restaurant I was pleased to see a large outdoor patio with plenty of tables, giving us the option to eat outdoors.? Now generally in the middle of an Arizona summer you won't see many outside, but the other 9 months of the year it's perfect weather to enjoy a meal outdoors.? On the particular day we went, it was overcast and cooler (a monsoon was blowing in), so there were quite a few people eating outside.? Inside, the dining room was large, brightly lit from all of the windows, and packed full of people.
And of course, since the kids were with us we also ordered a mac 'n cheese kid's meal and the pasta and red sauce kid's meal.
I was pleased that- even with taking all of the kids- we still spent less than we anticipated on spending, and about the same as we'd spend at other restaurants we go to.? For all this food- plus the drinks- we spent about $40.? Not bad for our big family, and we left stuffed (and with leftovers to go as well)!! The food was all amazing. I had trouble deciding which of the sandwiches I wanted, and I was glad the pizza was large enough that we all could enjoy it.? So I got a little of everything, as did Gary.? Neither of us could decide which we liked best, though he did prefer the panini bread over the flat bread on the sandwiches.? The portions were not huge, however they were much larger than other places we've been and they were definitely filling. The food was all made with fresh ingredients and tasted great, and we felt like we got our money's worth for sure.? Gary really liked the sauce on the pizza, and we all were amazed at how good the mac 'n cheese was; I could have eaten that for my lunch and been as pleased!

The pizza is generally made on thin-crust, but I prefer a thicker crust and so we went with that option.

Last week I wrote on the importance of refreshment and maintaining a regular time with God in honest recognition of His reign over your life.? If he needed it, we need to make sure that we incorporate a time of refreshment into our busy lives. But, we should purposefully center our rest and renewal around these suggested areas:
1)? A time to stay at home: Families are going in so many different directions today. Finding some time to recoup as a family by doing something special on a weekly basis helps to reconnect and refresh. You also model to your children the value of family time and the life-long, vital connections that are made early in life (remember the message of Cats in the Cradle).
2)? A time to read, study and write: I talked to someone the other day, who, in the process of writing out her Christian testimony, has been reminded of all the ways in which God was working in her life when she didn?t even realize it. This revelation brought a sense of excitement and joy. Reading Christian biographies and inspirational books will also buoy your spirit. SAN LEANDRO -- Registration has begun for the city's flag football league.
The league is open to boys and girls ages 5 to 14 and runs every Saturday, Sept. 8 through Nov. 10, at Washington Manor Park in San Leandro.
The noncompetitive program focuses on teamwork, sportsmanship and skill development in a no-pressure environment. Each participant will receive a reversible NFL team-identified jersey along with skilled coaching.
During the early registration period, which ends Aug. 27, the cost is $124 for San Leandro residents of San Leandro and $144 for nonresidents. Registration goes up to $149 for residents and $169 for nonresidents after that.
